Factory reset removes your personal files from easy access but does not permanently destroy data. The NTFS/HFS+ file system marks sectors as 'available' but the underlying data remains until overwritten. Recovery software available for free can retrieve most files from a factory-reset drive. For personal use, the risk is primarily identity theft. For corporate devices, the legal risk under DPDP Act 2023 also applies.

SSDs require different treatment than traditional hard drives. Standard file deletion and even some software overwrite tools are less effective on SSDs due to wear-levelling algorithms. The correct approach for SSDs is Cryptographic Erase (ATA Secure Erase or NVMe Sanitize command) — which EWaste Kochi applies by default — or physical destruction (shredding). HDDs can be overwritten with NIST Clear (3-pass) or degaussed.

If the device contained personal data about customers, employees, or any identifiable individuals, your company has an ongoing DPDP Act obligation that was not satisfied. The practical risk depends on whether the buyer recovered and misused that data. We recommend: (1) documenting that the device was sold and the data was believed erased, (2) reviewing what categories of personal data may have been present, (3) consulting your DPO or legal team on whether proactive disclosure is appropriate. Going forward, all corporate device disposals should use certified destruction.

You receive a Certificate of Data Destruction per device listing the serial number, destruction method, and date. This certificate satisfies DPDP Act 2023 and E-Waste Rules 2022 documentation requirements.
